DETECTRA – Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the DETECTRA mobile and web applications (the “App”), operated by Atreon SA, Chemin de Rennier 9, 1009 Pully, Switzerland (“we”, “us”, “our”).
By accessing or using DETECTRA, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree, you must not use the App.
1. Regulatory Status, Intended Use, and Disclaimer
For Investigational Use Only:
DETECTRA is a patient management system with remote monitoring of inflammatory arthritis. It is designed to support and manage patients diagnosed with or at risk of inflammatory arthritis, including Rheumatoid Arthritis (RA) and Psoriatic Arthritis (PsA). The system helps monitor disease onset, progression, and response to treatment through a mobile app for patients and a web dashboard for healthcare professionals (HCPs).
The App is not commercially approved or CE-marked as a medical device in any country (including the EU, Switzerland, UK or USA) at this stage. Regulatory submissions are planned.
Use is restricted to approved clinical research or pilot settings under the oversight of licensed investigators and in compliance with local laws and ethics committees.

2. Eligibility and Access
All users must:

Have access to a valid email address and internet connection.

Accept and comply with these terms and our Privacy Policy.
To use the DETECTRA Mobile App, you must:

Be at least 18 years old.

Be diagnosed with inflammatory arthritis or be assessed by a healthcare professional to be at the risk of developing it.

Be under the care of a healthcare provider using DETECTRA, or enrolled in an approved study or pilot program.

Have the ability to operate a smartphone and follow digital instructions to use the App effectively.
To use DETECTRA Healthcare Professional Dashboard, you must :

Be registered as part of a healthcare organisation validated by DETECTRA.

Be validated by the DETECTRA team as a qualified healthcare professional prior to accessing the HCP dashboard.
3. Contraindications and Limitations
DETECTRA should NOT be used:

By users who, due to cognitive, visual, motor, anatomical, or other significant impairments, are unable to understand instructions, operate a smartphone, or complete the required tasks (such as hand scanning and symptom reporting), even with reasonable accommodation.

By individuals whose anatomy (such as missing, absent, or significantly deformed fingers or hands) prevents the app from accurately capturing or assessing the required data.

In any other circumstance where, in the judgement of a qualified healthcare professional, use of the app would be inappropriate or where the results would not be reliable.
4. User Responsibilities
You agree to:

Use the App only for its intended investigational or health-related purposes.

Provide accurate and up-to-date health data, to the best of your knowledge.

Keep your login credentials confidential.
-
Not interfere with or disrupt the App, servers, or networks.
-
Not copy, reverse-engineer, or tamper with the App software.
-
Ensure your device meets the technical requirements specified in the user documentation (such as operating system versions, Internet access, and compatible hardware).
5. Intellectual Property
All content, algorithms, software, and documentation are the property of Atreon SA or its licensors.
You are granted a limited, revocable, non-exclusive licence to use DETECTRA for personal health monitoring in a clinical/research setting, as permitted by these Terms.
6. Data Use for Product Development
All processing of personal data in DETECTRA, where used as part of clinical trials or research, is carried out under relevant ethical approvals and subject to applicable data protection laws (including Swiss FADP and GDPR, where applicable).
By using the App, you agree that Atreon SA may process your personal data as described in our Privacy Policy. This includes the use of de-identified or pseudonymised health data for product development, research, algorithm training, validation, scientific publication, and regulatory submissions, always in a manner that protects your privacy and complies with legal requirements.
Your identity will never be revealed in any publication, analysis, or commercial use of data.

7. Data Subject Rights, Consent, and Withdrawal
For a full description of how your data is collected, used, stored, and protected, as well as your legal rights and how to exercise them (including access, correction, deletion, objection, or portability), please refer to our Privacy Policy.
By using DETECTRA, you explicitly consent to the collection and processing of your health data as explained in our Privacy Policy.
Withdrawal of your consent is possible at any time by contacting us. Upon withdrawal, your directly identifiable data will be deleted or anonymised within 30 days, except as required for legal, regulatory, or research purposes and as outlined in the Privacy Policy.
8. Limitation of Liability
To the maximum extent permitted by law:

We shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, loss of health outcomes, loss of profits, or interruption of service.

Our total liability in connection with your use of the App shall not exceed CHF 100, except in cases of gross negligence, wilful misconduct, or where such limitation cannot be excluded by law.

Nothing in these Terms limits liability for death, personal injury caused by negligence, or any rights that cannot be limited by law.
9. Termination
We may suspend, terminate or deactivate your access if you violate these Terms or as required for research or regulatory reasons.
You may delete your account at any time, in terms of the process for this, please refer to our Privacy Policy.
Upon account deletion, your data will be deleted or anonymised, except where retention is required for research, regulatory, or legal compliance as explained in our Privacy Policy.
10. Arbitration and Dispute Resolution
Any dispute arising out of or relating to these Terms shall first be subject to good-faith negotiation. If unresolved, the dispute shall be settled by binding arbitration in Lausanne, Switzerland, under Swiss law.
Where local consumer protection law or mandatory jurisdiction applies (e.g., Germany, Austria, Denmark, EU/EEA, UK, USA), those rights shall prevail over this clause to the extent they cannot be waived by law. You waive your right to participate in class actions, collective actions, or jury trials, to the extent permitted by law.
11. Changes to These Terms
We may revise these Terms to reflect updates, legal requirements, or user feedback.
Changes will be posted with the “Effective Date” above.
Continued use of the App after an update constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by Swiss law.
Any disputes will be handled primarily under arbitration in Lausanne, Switzerland, subject to the above consumer protection provision.
